WAGNER V. COULTER.
This was an action brought by Samuel Wagner, grocer of Ann-street, Brisbane, v. W. P. Coulter, of James-street, Teneriffe. Plaintiff sued for £12 10s., which amount was said to be the balance due on a horse, cart and harness sold by him to defendant. Mr. F. W. Dickson (instructed by Mr. G. I. Dickson) appeared for plaintiff, and defendant was represented by Mr. Hobbs (instructed by Messrs. M'Grath and O'Neill).
The defence was that the horse had proved to be unsound, but plaintiff said that he had given no warranty with the animal
The plaintiff (Samuel Wagner) stated that the defendant came to his shop in March and inquired about a horse, dray, and harness witness had for sale. He sold them for £47 10s. Defendant paid him £35 that day, and took possession of the horse and dray. He agreed to pay the balance as soon as possible. Witness gave no warranty as to the horse being sound. A few days later defendant came to him, and said the horse was no good, and wanted his money back. Wagner refused this demand, and defendant said he would not pay the balance. Witness sold the horse, believing it to be sound, but gave no warranty with it.
A. O'Toole and C. A. G. Spann also gave evidence for the plaintiff.
For the defence Mr. Hobbs claimed that a verbal warranty had been given with the horse.
William P. Coulter, the defendant, deposed that the plaintiff said to him, "I guarantee the mare to be thoroughly good and stanch" He also told witness that the horse and dray were good for any work. Soon after he had bought the horse he noticed it was short in the wind and was unable to draw an ordinary load.
Mr. Dickson : Why did you not ask for a guarantee in writing? Witness : Because it was not necessary, when I had witnesses.
Are you relying upon your wife as a witness of the transaction ? - Witness : My wife and Mr. Palmer. He was also prent
His Honour : It is a pity Mr. Palmer is not here. I think it will be necessary to adjourn the case until we get his evidence.
Mr. Dickson : Yes, your Honour. We telegraphed for him and cannot understand why he is not here.
To Mr. Dickson : The veterinary surgeon who examined the horse said it was asthmatical ; she was a "roarer." (Laughter.)
Frank Nott, a veterinary surgeon, stated that his examination of the horse showed it to be suffering from asthma, or broken wind. The mare was quite unsound and incapable of working in a dray.
To Mr. Dickson : Anyone driving the horse should notice that it was suffering.
Ellen Coulter, wife of defendant, corroberated her husband's evidence as to plaintiff guaranteeing the horse.
William Cowan and Michael 0'Connell also gave evidence for the defence.
At this stage the case was adjourned until to-day in order to hear the evidence of a witness whose statement is considered material to the issue.

The art union in connection with the sports carnival was drawn on Saturday evening at the Society's rooms, Queen Sreet, in the presence of a large attendance of the public.
