    CHARGE OF ASSAULT CASE DISMISSED.
    A case in which Samuel Nolan proceeded against Jules Metzger for assault, was brought before Mr E. Harrison, P.M., yesterday and engaged a good deal of time. From the evidence put forward, Nolan had been engaged by defendant in grubbing and splitting timber, and on the 7th instant had returned from work and was sitting near the stable door with his brother, William Nolan, when defendant came to the stables and asked why complainant was not assisting the boy with the horses.
    Defendant stated that he brushed quickly passed Nolan, and when doing so was struck in the lip by him, and an altercation ensued. Blow followed blow, and this caused two terriers, owned by the combatants, to join in the fray, with the result that, according to the evidence of complainant, he was severely bitten on the leg.
    Complainant further stated that the terrier owned by defendant was urged on to do further dammge. Evidence was given for the defence by Mrs Metzger and her son Ivan, a boy of about 11 years.
    After carefully examining the evidence the P.M. dismissed the ease, with £3 2s profesional costs.

    SHIRE MATTERS.
    ROAD REPAIRS, ETC.
    On Tuesday at the Shire Council meeting, councillors generally brought forward the necessity for repairing roads in various parts of the Shire.
    Cr Simpson inquired what was being
    done in reference to culvert near Metzgez's, Doctor's Creek. The engineer said Mr Metzger had asked that the formation be extended past his place.
    The culvert was an obstacle to the water and Mr Metzger agreed to give a hand to pull the culvert out and widen it. If he did so that was the best way out of the difficulty. The matter was left in the engineer's hands on the motion of the president and Cr Holden.

    MR. JULES METZGER:
    The death occurred on Monday evening at his residence, St. Louis' Vineyard, Doctors Creek, Of Mr. Jules Metzger a well known vigernon, at the age of 70 years. He had been ailing for about six months. The deceased gentelman was a native of Bendigo though most of his life was spent in the Stawell district, where his quiet and gentlemanly nature won for him the respect of residents right through the district. He wasa member of the B.A.C.B.S. Lodge. Sincere symphathy is extended to his widow and adopted son. The funeral is appointed to leave his late residence, Doctor's Creek for the Stawell Cemetery at 3 o'clock this afternoon, and members of the B.A.C.B.S. Lodge are invited to attend.
