    William Smithwick was charged with the larceny at four hoops and one bundle of small hoops, need for tallow casks, the property of Hansen and Jenesen. Senior Sergeant Gallagher conducted the tbe prosecution.
    Senior Constable Glancy called, stated: By virtue of the warrant (produced) searched the premises occupied by
    accused in Lennox Street, for stolen goods-four large iron hoops, and one bundle of small iron hoops-Jensen accompanied me; found five large iron hoops (produced), in the shop of accused; he was present at the time; two of the hoops were on casks in construction, the three other hoops lying alongside; took possession of them after Jensen had identified them as the property of his firm; accused said his wife had brought them from Brisbane five weeks ago; we then went to accused's residence in Ferry Street; and after searching found the small hoops (produced) accused said "I made those hoops myself by picking up from time to time old pieces of hoop iron"; Jensen identified them as the property of his firm; brought accused to the watchhouse and there charged him with tee larceny of all the hoops produced in court; be said nothing.
    Edward Nicholas Jensen deposed: Am a cooper and partner of the firm of Hansen and Jensen, carrying on business as blacksmiths, wheelwrights, and coopers, corner of Ellena and Lennox Streets; know the accused; he was in our employ from the 19th November to 6th December, 1891, as a Cooper; see the five hoops (produced), recognise them as the property of the firm; missed them from the workshop about a week before Christmas; reported the loss to the police; on the 8th January went to the workshop of accused; there saw the five large hoops (produced) in bis workshop; one was on a cask that was being made; a workman was in the shop when I went in: waited a few minutes and the accused came in; said to him, "You are using our hoops;" he replied, "I believe you are mistaken;" I said, "I would not say it if I was not sure;" He replied, "My wife brought them up from Brisbane; do you mean to say I went into your yard and stole the boops;" I said "I would not say you stole them but they are the hoops we missed;" obtained a search warrant and accompanied Senior Constable Glancy to the shop of the accused; the constable took possession of five large hoops; we then went with accused to his residence in Ferry Street; Constable Glancy said "Have you got any hoops in the place;" accused replied "No, only this one," pointing to an old one lying outside; saw Glancv take out from underneath the house one hoop similar to the small ones we had missed; the constable got a long stick with a hook on the end and got out from underneath the house nine more hoops similar to those we had lost; Glancy asked him why he put the hoops under the house; accused said, "So the children could not play with them;" he said they were hoops he had made from time to time at the different workshops where he bad been working; the value of the hoops I put down at 15s.; never sold the hoops to accused, or authorized him or anyone else to take them away.
    Cross-examined by accused: I swear the big hoops are ours; I can show marks upon them; have been using these hoops two years; made three of them myself; I cannot swear positively to the smaller hoops as being ours; but they are similar to the ones we lost. Re-examined; The smaller hoops we found were about eight or ten feet underneath the house; it stands about seven or eight inches from the ground.
    At this stage the accused was remanded for a fortnight, bail allowed in one security of £10.
