    • The second civil sittings of the Supreme Court will bo opened today, before his Honour the Chief Justice (Sir Pope Cooper). The list of cases is as follows: -John James Walker v. Charles William Walker and Mary Ellen Walker, in which the plaintiff seeks for a declaration that C. W. Walker was lately and M. E. Walker now Is registered proprietor of certain land, and that land is held as to 200 acres upon trust for plaintiff, and as to 51 acres upon trust for the next of kin of the plaintiff's father, who is now deceased.

    • Before his Honour the Chief Justice, Sir Pope A. Cooper, K.C.M.G., and juries of four.
      WALKER v. WALKER AND ANOTHER.
      Mr. A. D. Graham (instructed by Messrs. Atthow and M'Gregor) for the plaintiff; Mr. T. G. Ryan, with him Mr. J. Mahoney (instructed by Messrs. Fitzgerald and Walsh), for the defendants. The following jury was impanelled: William Bulcock, Alexander Clark, Henry W. Atkinson, James Jack. This was an action brought by John James Walker, a farmer, residing at Maleny, against Charles William Walker, railway employee, residing at Rockhampton, and Mary Ellen Walker, brother and sister-in-law of the plaintiff, respectively, in which he claimed a declaration that the ? defendant held and the female defendant now held a selection of land at Maleny as to 300 acres thereof as a trustee for the plaintiff, and as to 51 acres as a trustee for the next of kin, John Walker, deceased, intestate. ln the alternative the plaintiff claimed against the male defendant 1300 for work and labour done and money expended, and improvements effected on the lands by the plaintiff for the defendant at his request and for his benefit. The
      plintiff claimed as against the female defendant an injunction restraining ber from selling, charging, or otherwise dealing with the selection except subject to the right of the plaintiff and the said next of kin, a conveyance in terms of the declaration or in the alternative that the transfer to her be declared fraudulent and void.The statement of claim set out that in 1880 the male defendant selected under the Crown Lands Alienation Act of 1867 selection No. 3389A, being portion 1271, parish of Maleny, county of March, containing 651 acres as a conditional purchase selection. Shortly after the application the male defendant requested the plaintiff to make all the necessary improvements to enable the defendant to obtain a certificate of title for the freehold, and also certain other improvements to enhance its value. The male defendant verbally promised and agreed to fully pay and compensate the plaintiff for all the work done by him. The plaintiff therefore went and resided upon the selection, and at his
      own expense, and by his own labour made the required improvements. In 1883 the male defendant obtained the freehold title, and shortly afterwards an agreement in writing was made between the plaintiff and the male defendant that instead of making any payment the defendant should transfer to the plaintiff 200 acres of the selection, also 200 acres to Stephen Walker, and 40 acres to Sarah Ann Walker, their mother. The plaintiff had continued to reside and still resided upon the selection and had greatly improved it. The defendant though frequently requested to do so had refused to transfer the arces of land. About August, 1912, the male defendant for the consideration and natural love and affection conveyed to the female defendant the fee simple of the selection. Sarah Ann Walker died intestate about 1888, and John Walker, her husband, died intestate about 1890. and plaintiff was entitled to share in the distribution of the intestate estate of John Walker.,The defence was a general denial of the claims of the
      plaintiff, and the female defendant counterclaimed 200. damages for trespass by the plaintiff, and an injunction to restrain the plaintiff or his servants from interfering with her possessions of the land. Mr. Graham, in the course of his opening statement, mentioned that substantial offers had been made on behalf of the defendants to the plaintiff's solicitors to settle the action, and he thought it would be well if the parties could meet before the case proceeded any further in order to try to come to a settlement. The Chief Justice said he approved of the parties meeting, without any professional intervention, and trying to come to some arrangement. The court was accordingly adjourned for half an hour, at the end of which it was announced by Mr. Graham, that the parties had arranged a settlement the terms of which were not disclosed. The case therefore was struck out by consent.

    • STRUCK BY BICYCLE.
      When he was knocked down, by a bicycle at the corner of George and Elizabeth streets, city, shortly after 4 o'clock yesterday afternoon, John James Walker, an adult, of Deshon-street, South Brisbane, sustained a probable fracture of the left thigh, and suffered from shock. After receiving attention from the Ambulance Brigade he was conveyed to the General Hospital.
